The information contained in this website or software, including any other website, is provided for general informational purposes as a convenience to our subscribers.  This information is not a substitute for obtaining professional advice from a qualified person, company or licensed insurance professional or consultant. Therefore, you should not rely solely upon this information in making any decision, including any decision to buy or terminate Workers Compensation or any other type of insurance.

We claim no ownership of or intellectual property rights in any information you submit through the software. We do however have a right and in some cases, the responsibility to forward the information about your subcontractors to their insurance carrier.  Additionally, if your insurance carrier has a Master License Agreement and you are participating through their Agreement, your information will be shared with your insurance carrier.  The purpose of releasing this information or data about the monitored subcontractor is to reduce the likelihood of an injury, casualty, or death, as well as to make certain that the insurance carrier has properly structured the insurance policy and that the insurance carrier is prepared to pay losses at your job site and that your insurance carriers, both Workers Compensation, General Liability or other.  Furthermore, there are certain laws in certain states that require the insurance carrier of subcontractors, to cover the owners, principals or officers of these companies, even if these individuals had declined the coverage.

Conditioned on your compliance with this Agreement, payment of applicable licensing fees and fulfillment of any applicable obligations, Insurance TechKNOWLEDGEy, LLC grants to you a personal, limited, nonexclusive and nontransferable license to use the software referred to as AuditorPortal, Insurance Verification Exchange and  Insurance TechKNOWLEDGEy, LLC reserves all rights of ownership of the software and does not grant to you a license to distribute or extend a service to monitor Workers Compensation through the software or create an enterprise to track or monitor Workers Compensation coverage for others as this would compete against our company for said services.  You agree not to use the software or this website in any manner that violates any applicable law, regulation, or term of this Agreement.  Specifically, you agree that you will NOT:

1.) access or attempt to access any account that you are not authorized to access or is not your account,

2.) reverse engineer the software or website content,

3.) modify or attempt to modify the software in any manner or form,

4.) modify or attempt to modify the list of another subscriber’s list of monitored Workers Compensation policies,

5.) copy, distribute, or create derivative works,

6.) exploit the in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity, or

7.) resell, sell, sub-license, or otherwise convey a license or agreement to another party to use the software (except those rights expressed by another license agreement).

Insurance TechKNOWLEDGEy, our owners, founders, officers, directors, managers, shareholders, associates, employees, affiliates, associations, agents, agencies, brokerages, contractors, licensors, data suppliers, state databases, endorsing entities, insurance carriers, or resellers shall not be liable or responsible to you, your affiliates, insurance carriers, risk bearers, or any other person or entity for:

1.) lost income,

2.) future income,

3.) lost profits,

4.) loss of data,

5.) direct or indirect damage,

6.) punitive or incidental damage,

7.) injury, bodily injury or property damage, and

8.) premium increases or changes.

You are solely responsible for the security of your registration information, user name and password, and for any and all use of your account. You agree to notify us in writing immediately at the address on the contact us location if you suspect any unauthorized use of or access to your account.

You agree to indemnify, defend, and hold harmless our shareholders, subsidiaries, affiliates, officers, directors, agents, employees, partners and licensors from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the software, AuditorPortal, Insurance Verification Exchange and

The laws of the State of Tennessee, without regard to conflict of law provisions, govern this Agreement and your use of the said software.  You agree to exclusive personal jurisdiction and venue in the State of Tennessee and federal courts of the United States located in the State of Tennessee for any claim or dispute with us or in any way relating to or arising from your use of the software.

The failure of Insurance TechKNOWLEDGEy to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision.  This Agreement constitutes the entire agreement between us and governs your use of the information provided by the software.  No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this agreement.  If any part of this Agreement is held invalid or unenforceable, that portion will be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions will remain in full force and effect.  Our failure to enforce any right or provisions in this Agreement will not constitute a waiver of that provision or any other provision of this Agreement.  We may revise and update this Agreement from time to time.  If you are a registered user, we may attempt to inform you of any material changes by notification to the email address you have provided as part of your Registration Information.

By the accepting the Software License Agreement, you agree that we are not responsible for any problems or technical malfunction of any network, computer systems, servers, providers, data, computer equipment, software, or for any failure to receive or deliver information due to technical problems or computer congestion on the internet or a combination thereof, including any injury or damage to users or to any computer or other device.  Under no circumstances will we be liable for any loss or damage, including personal injury or death, resulting from use of the software, failure of software or from the conduct of any subcontractor,  subcontractor’s employees or OSHA or state specific or other safety programs.

AuditorPortal, Insurance Verification Exchange and is the marketing name for this proof of coverage service, in particular Workers Compensation coverage.  Not all states data of active and non-active Workers Compensation insurance policies are maintained inside this software or service.  For a complete list of states, please see “States Covered.”  We will be adding to this list of states periodically.

When our company collects information from a particular state’s database of active and inactive Workers Compensation policies, we are reliant on this information as accurate.  It is intended solely for the subscribing licensee to decide if a subcontractor’s Workers Compensation coverage is active or not.  The subscriber should still maintain Workers Compensation coverage and any other insurance that properly protects the subscriber. Additionally, the subscriber should obtain legal advice from a lawyer regarding contracts entered into with another party, in particular a subcontractor performing work on behalf of the subscriber.

Information about subcontractors may be shared with their insurance carriers about jobs that their policyholders are working (i.e. the subcontractor working for the subscriber).  This information may include the subscriber’s name; however, we will not reveal information about the subscriber’s personal information.

Insurance TechKNOWLEDGEy, LLC reserves the right at its discretion to modify, remove or add portions of the Terms at any time.  Please check the Terms periodically for changes.

The software program owned and marketed by Insurance TechKNOWLEDGEy, LLC.  The purpose of the software is to assist a subscriber in evaluating if a subcontractor working for the subscriber is covered for Workers Compensation insurance in a specific state in which work is being performed or may be performed.  The information provided by the service is only valid if the insurance carrier of the subcontractor updates the records with the IVE or the state in which the records are received.  The subcontractor may fail to maintain the Workers Compensation insurance policy and these instances the subcontractor should stop work immediately. Some states or insurance companies may not report to IVE, in those cases the subscriber should confirm the coverage through a Certificate of Insurance often.

Although care has been taken to ensure the accuracy, completeness and reliability of the information provided, Insurance TechKNOWLEDGEy, LLC assumes no responsibility therefore.  The user of the information agrees by using the information that the information is subject to change without notice and that Insurance TechKNOWLEDGEy, LLC assumes no responsibility for the consequences of use of such information and shall in no event be liable for any direct, indirect, special or incidental damage resulting from, arising out of or in connection with the use of the information.
